Terms & Conditions
All contracts made by the Company (''the Seller") for the supply of its products ("the Products") to a customer ("the Buyer") shall be governed by the following conditions to the total exclusion of any other whether verbal or written unless varied in writing by the Seller.
- We reserve the right to change terms & conditions at our discretion - we would recommend they are reviewed regularly. All changes are effective as and when they are published on the website.
- When placing an order on the Beautiful Walls website you must be over 18 years of age, be legally capable of entering into a binding contract and possess a valid credit or debit card.
The Seller shall not be liable for any indirect or consequential loss, damage or expense howsoever arising and in no circumstances shall the liability of the Seller exceed the invoice price of the products in regard to which a complaint is made.
Nothing in these conditions shall:
- limit or exclude the liability of the Seller in respect of death or personal injury resulting from negligence or the Seller it's employees or agents.
- exclude the conditions and warranties implied by Section 12 of the Sale of Goods Act 1979.
We will not be liable to you (or any other user of our website) for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use or inability to use our website or reliance on the content displayed on the website.
Items identified by the Buyer to be defective will, if accepted by the Seller as defective, be replaced as originally ordered, or refunded – according to the Buyer’s preference.
We recommend that you check all products for defects or discrepancies as soon as possible. If you find a defect or discrepancy in the products, or suffer loss or damage, please let us know as soon as you become aware of the relevant issue. You should then take all reasonable steps to minimise the damage or loss you may suffer. For example, if you should find the wallpaper does not match the wallpaper you had ordered, you should stop and tell us about the problem and not carry on papering your walls with the wrong wallpaper.
No claim for damage in transit, shortage of delivery or full loss of goods shall be entertained unless notice is received by the Seller within 3 days of delivery or where there is no delivery, within 7 days of the date when the product would in the ordinary course of events have been delivered.
Delivery dates are estimates only and the Seller shall have no liability for delay in delivery howsoever arising.
Risk shall pass on delivery which shall be taken to be when the products are delivered at the point at which they are offloaded from the Seller's or his Agents vehicle at the agreed delivery point.
The Seller shall not be liable in any way for delays of failure to perform resulting from any cause beyond its control and may suspend or rescind the contract in such an event.
Any dispute may at any time be referred by either party to a single arbitrator appointed in accordance with the terms of the Arbitration Act 1950 or any statutory modification or re-enactment thereof.
The contract shall be subject to and be construed in accordance with English Law.
Any ‘Special Orders’ by the Buyer are non returnable and non refundable unless they prove to be faulty.
All trademarks, logos, images and content remain the property of S J Dixon & Son Ltd. You are not permitted to reproduce, duplicate or manipulate any of the content and/or images without the explicit consent of S J Dixon & Son Ltd.
Every effort is made to ensure that the colour and design of the product appear as accurately as possible, however the actual colours you will see can vary dependent upon your computer equipment and, as such, we cannot guarantee that the goods on delivery will reflect the colour on your computer. Therefore, we would highly recommend that all customers use our sampling service to check the colours prior to placing any order.
